My game has external resources and I want to give away an Mp3 pack to make the music sound better. It will be available for an extra download but I don't know if that is technicly legal? So is it?

If you are making a game that you plan on selling and you use MP3s, then you have to purchase a license to us the MP3s in your product. However, if it is freeware then there is no license needed.
I mean, if I was to use (lets say) a gerudo valley Mp3 in my game would it count as illegal distrubution of Mp3 because everyone can acces my folders even if they don't want to play them game?

If the music is copyrighted, then it's illegal to distribute no matter what format it's in, or how it's encrypted.

The MP3 format is a protected patent, and you DO need a license to distribute software that encodes or decodes it. But as far as I can tell, selling MP3 files themselves, of non-copyrighted music, is fine. Since Game Maker (which I assume you're using?) allows the format, then it's safe to say that's all taken care of.

However when GM cozies up to Ogg Vorbis files, it would be best to switch to using them. They're patent-free, and supposedly better quality than MP3.

OF Course ogg is the better most game companies use it (id Software for one) they also use .wavs for smaller files (poking around in Quake  series pak files i found this out *hugs pakscape*)
