Many Fangames have MP3's, but I want to ask which MP3 is legal for a Zelda Fangame.
What do you think about this?

Just stick to midi.  Not sure if you can use mp3s but I do know you cannot claim them as your own.

If you look hard enough, you can find midis that sound exactly identical to some Zelda songs or any other songs you are looking for.

Fair Use gives you roughly 30 second clips

The container (mp3) doesn't matter so much as the content (The song itself)

Generally speaking, if you're not selling your game, you're fine to use whatever you want art/sound asset-wise from Nintendo, and the worst you could get is a cease and desist letter

If you try to use like Guns N' Roses in your game you're not selling? You're probably fine there too to be honest. Again, before they would take you to court they'd send you a letter asking you to stop.

But don't try to sell ANYTHING that you or your team doesn't create yourself.

Adding to this, your fangame cannot be sold because it is a fangame, regardless of whether all the content is custom or not. You are using a franchise that is copyrighted as a base.

Not even if you replace all the vowels with O's... I learned this the hard way when I tried to sell THE LOGOND OF ZOLDO: A LONK TO THE POST

I am not sure, but I read once that even MP3 is a patented codec and that you have to pay for its commercial use or something. If you want a free audio codec it is OGG that you need. When you want to use audio in a indie game.

You missed 3 vowels in replacing them with O's maybe that is what went wrong  :P
